In the individual applications of the defendant officers in the counter-case, the Constitutional Court (AYM) has found systematic violations under the right to liberty and security and the right to a fair trial. Applications pending before the ECtHR are being assessed in light of key precedents such as Alparslan Altan (2019), Hakan Baş (2020), and Yalçınkaya v. Turkey (Grand Chamber, 2023).
