The court order not executed

The search order for the morning of December 25, 2013 was not implemented by the new Financial Crimes chiefs who took office through midnight appointments. The new chiefs invoked "the confidentiality of the investigation has been breached" as their grounds. This practice — contrary to a judicial order under CMK art.116 — is an unprecedented record in Turkish judicial history.

"The confidentiality of our investigation has been breached; the pressure upon us has reached unspeakable proportions." — Muammer Akkaş, press statement, December 26, 2013

Removal of Prosecutor Muammer Akkaş

On December 26, 2013, Prosecutor Muammer Akkaş's jurisdiction was stripped. His press statement announcing his removal stands as one of the most extraordinary records in Turkish judicial history.

The file passes through three prosecutors

The file was reassigned in order to İrfan Fidan, İsmail Uçar, and Fuzuli Aydoğdu. All three were noted for rapidly rising careers afterward — Fidan was later elevated to the Constitutional Court.

July 25, 2014 KYOK

The non-prosecution order of July 25, 2014 formally closed the file. The order rests on grounds that ignore an extraordinary volume of evidence — 71 suspects, 20 months of wiretaps, approvals from 19 judges, 15 separate categories of acts.

Objections rejected

Objections to the order were rejected by the relevant magistrates. For AYM and ECtHR applications: /international/ecthr.
